Please read these Terms & Conditions carefully before making a booking. By completing a booking with Gracious Summit Unipessoal LDA you confirm that you have read, understood and agree to be bound by these terms. If you are booking on behalf of a group, you accept these terms on behalf of all members of your party.
1. Introduction
These Terms & Conditions govern all bookings made with Gracious Summit Unipessoal LDA (hereinafter "Gracious Summit", "we", "us", "our"), a company incorporated and registered in Portugal.

We are a licensed travel agency and Destination Management Company (DMC) regulated by Turismo de Portugal.
2. Definitions
- "Booking" means any confirmed reservation of a tour, package, cruise or other travel service arranged by Gracious Summit.
- "Package" means a pre-arranged combination of at least two travel services (e.g. transport + accommodation) as defined by the EU Package Travel Directive (2015/2302/EU).
- "Lead passenger" means the person who makes the booking and accepts these terms on behalf of all party members.
- "Supplier" means any third-party airline, hotel, cruise line, transfer operator, tour guide or excursion provider engaged by Gracious Summit.
- "You"/"your" means the lead passenger and all members of the travelling party.
- "Departure date" means the first date of the booked travel service.
3. Booking Process
3.1 How to book
Bookings may be made via our website, by telephone, by email, or in person at our office. A booking is confirmed only when:
- We have issued a written Booking Confirmation to your email address, and
- We have received your required deposit or full payment (see Section 4).
3.2 Accuracy of information
You are responsible for ensuring all passenger details (names as per passport, dates of birth, nationality, passport numbers) are correct at the time of booking. Any corrections required after tickets have been issued may incur amendment fees charged by the relevant supplier.
3.3 Minimum age
The lead passenger must be at least 18 years of age. Minors must be accompanied by a parent or legal guardian unless we expressly confirm otherwise in writing.

Late payment: If the balance is not received by the due date, we reserve the right to treat the booking as cancelled and apply the cancellation charges set out in Section 6.
4.2 Accepted payment methods
We accept payment by credit/debit card (Visa, Mastercard, American Express) via our secure Stripe payment gateway, and by bank transfer (IBAN provided on invoice). Card payments are subject to a processing fee of up to 1.5% for non-EU cards.
5. Pricing, Surcharges & Price Guarantees
5.1 Prices
All prices are quoted in Euros (€) per person unless otherwise stated. Prices include VAT where applicable. Prices shown on our website are indicative and based on availability at the time of publication; the confirmed price will be shown in your Booking Confirmation.
5.2 Surcharges
After your Booking Confirmation has been issued, we may pass on increases in the following costs in accordance with the EU Package Travel Directive:
- The price of fuel or other energy sources for transport
- Taxes or fees imposed by governments or port/airport authorities
- Exchange rates applicable to the package
Surcharges will not be applied within 20 days of the departure date. If a surcharge would increase the total price by more than 8%, you may cancel without penalty (see Section 6.3).
5.3 Price guarantee
Once a booking is confirmed and full payment received, the price is guaranteed against fuel surcharges and exchange-rate fluctuations.
6. Cancellation by You
All cancellation requests must be made in writing to info@gracioussummit.com. The cancellation takes effect on the date we receive written notice. The following charges apply:

Note: Some airlines, hotels and cruise lines impose non-refundable elements (e.g. low-cost carrier fares, non-flex hotel rates). These charges are passed on in full and may result in higher cancellation fees than those listed above.
6.3 Cancellation due to unavoidable extraordinary circumstances
If you are unable to travel due to unavoidable and extraordinary circumstances significantly affecting the destination (e.g. natural disaster, official travel advisory), you may be entitled to a full refund under the EU Package Travel Directive. Please contact us as soon as possible.
7. Amendments by You
Requests to amend confirmed bookings (change of dates, passenger names, room type, etc.) must be made in writing. We will endeavour to accommodate amendments subject to availability. An administration fee of €30 per person per amendment applies, plus any additional costs charged by suppliers.
Requests received less than 30 days before departure may be treated as a cancellation and re-booking at the then-current price.
8. Cancellation or Significant Changes by Us
8.1 Cancellation by Gracious Summit
We reserve the right to cancel a booking where:
- A minimum group size is not reached (we will notify you no later than 20 days before departure for packages of more than 6 nights, 7 days before departure for packages of 2–6 nights)
- Circumstances beyond our control make performance impossible or impractical
- You have failed to make payment by the due date
If we cancel (except due to non-payment), you are entitled to a full refund or an alternative package of equivalent or superior value at no extra charge.
8.2 Significant changes before departure
If we make a significant change to your booking (e.g. change of departure airport, significant downgrade of accommodation, price increase >8%), we will notify you as soon as practicable. You may:
- Accept the modification
- Accept a substitute package offered by us
- Cancel and receive a full refund
9. EU Package Travel Directive Compliance
Where your booking constitutes a Package as defined by Directive (EU) 2015/2302 (implemented in Portugal by Decreto-Lei 61/2018), you benefit from the following statutory rights:
- Pre-departure information about the package, your destination, transport, accommodation and any visa requirements
- Protection against price increases beyond 8% of the total package price
- Right to transfer your booking to another person (subject to reasonable notice and any supplier charges)
- Right to cancel if significant changes are made before departure
- Assistance if you are in difficulty during travel
- A refund and repatriation if we become insolvent
- Insolvency protection: Gracious Summit holds the mandatory insolvency protection bond as required by Turismo de Portugal and Decree-Law 61/2018
A standardised information form (as required by the EU Package Travel Directive) will be provided to you before you confirm your booking.
10. Travel Documents, Visas & Health Requirements
It is your responsibility to ensure you hold a valid passport and any required visas, entry permits, vaccinations or health certificates for all destinations in your itinerary. We will provide general guidance on visa requirements, but this does not constitute legal advice and requirements can change.
EU citizens travelling within the EU/Schengen Area may use a national ID card. Travel outside the EU requires a passport valid for at least 6 months beyond the return date.
We accept no liability for costs or losses arising from failure to hold appropriate documentation or from being denied boarding or entry at any point in your journey.
11. Travel Insurance
We strongly recommend that all travellers take out comprehensive travel insurance covering at a minimum:
- Cancellation and curtailment
- Medical expenses and repatriation
- Personal accident
- Baggage and personal effects
- Travel delay and missed departure
For cruise holidays, ensure your policy covers cabin-to-cabin medical treatment on board. We can refer you to a licensed insurance broker upon request.
12. Behaviour & Conduct
You are responsible for the behaviour of all members of your party. We reserve the right to remove any passenger from a tour or service whose behaviour is, in the reasonable opinion of our staff or a supplier, likely to cause distress, danger, or damage to property. In such cases no refund will be given and we will not be liable for additional costs incurred.
13. Our Liability
13.1 Packages
For confirmed Packages, our liability for any loss or damage you suffer due to our negligence or the negligence of our suppliers is limited to three times the total cost of the package, except in cases of death, personal injury or damage caused intentionally or by gross negligence, which are not subject to any financial cap.
13.2 Non-package bookings
For individual travel components not forming part of a Package, our liability is limited to the amount paid for that component and is subject to the terms and conditions of the relevant supplier.
13.3 Exclusions
We shall not be liable for loss or damage caused by:
- Your own act or omission or that of a member of your party
- The act or omission of a third party unconnected with the provision of our services
- Unusual or unforeseeable circumstances beyond our reasonable control (force majeure)
- Events which could not have been foreseen or prevented even with all due care
13.4 International conventions
Our liability in respect of air travel is governed by the Montreal Convention (1999); for rail travel by COTIF/CIV; for sea travel by the Athens Convention as applicable.
14. Complaints
If you have a problem during your trip, you must report it to our representative or the relevant supplier immediately to allow us to resolve it during your trip. If not resolved, please submit a formal complaint in writing to info@gracioussummit.com within 28 days of your return date, including your booking reference and a full description of the issue.
We will acknowledge your complaint within 2 working days and aim to resolve it within 28 days. If you are not satisfied with our response, you may refer the matter to the Portuguese arbitration centre (CNIACC) or the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, volcanic eruptions, severe weather)
- Pandemic or epidemic declared by the World Health Organization or Portuguese authorities
- War, civil unrest, terrorism or threat thereof
- Industrial action by third parties
- Decisions of governments or regulatory authorities
- Failure of utility services
In the event of force majeure affecting a Package, the provisions of the EU Package Travel Directive shall apply.
16. Data Protection & Privacy
We collect and process personal data in accordance with our Privacy & Cookie Policy and applicable data-protection legislation including the GDPR. By making a booking, you acknowledge that personal data of all party members may be processed and transferred to suppliers (airlines, hotels, cruise lines) as necessary to fulfil the booking.

The content of this website is for general information purposes only. While we endeavour to keep information up to date, we make no warranties about the completeness or accuracy of website content. Prices, availability and itineraries shown on the website are subject to change without notice.
All content on this website (text, images, logos, design) is the intellectual property of Gracious Summit Unipessoal LDA or its licensors and may not be reproduced without written permission.
18. Governing Law & Jurisdiction
These Terms & Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of Portugal. Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Lisboa, Portugal, unless mandatory consumer protection legislation in your country of residence requires otherwise.
If you are a consumer in the EU, you also retain the benefit of any mandatory provisions of the law of your country of habitual residence.
